What is e-CMR? The paperless consignment note explained
e-CMR is the electronic form of the CMR consignment note. Its legal basis, what it offers and what to check when looking at contracting states.
· 4 мин чтения
The CMR consignment note has been made out on paper for decades: three copies, signatures, stamps, a crumpled sheet in the driver's bag. e-CMR is the electronic form of this document and is meant to carry the same legal weight.
Legal basis
e-CMR became possible through an Additional Protocol to the CMR Convention. The protocol was adopted in 2008 and covers the electronic issue, signature and storage of the consignment note. On carriage between countries that have ratified it, an e-CMR can have the same validity as a paper CMR. To understand the paper CMR first, see our article on the CMR note.
Which countries are parties?
The number of parties has grown over the years, but the list is not fixed. Official records show that Turkey is a party to the protocol; still, check every country on your route against the current list of parties from the UN and UNECE each time. Read the list from the official source, not from a blog. If a country is not a party, you may still have to issue a paper CMR for that carriage.
How it works in practice
An e-CMR platform is usually used. The process looks like this:
- The sender enters the transport details and an electronic consignment note is created.
- The carrier and driver confirm it; an electronic signature is given at loading.
- During the trip the document can be updated; reservations, notes and photos can be added.
- At delivery the consignee signs electronically; the note is completed and sent to the parties.
The parties agree on the platform in advance. How well the platform secures electronic signatures and records determines the evidential value of the document.
Advantages
- Speed: the delivery signature is visible instantly; payment does not wait for paper to arrive by post or courier.
- Less risk of loss or damage: no wet, torn or lost copies.
- Legibility: fewer handwriting errors and missing fields.
- Traceability: reservations are on record with date and time, so there is less argument afterwards.
- Less paper and admin: no archiving or scanning.
Things to watch
- Both sides must use the same system.
- The driver's phone or device must work in areas with no signal; keeping a paper copy as a fallback can be wise.
- Customs and authorities may treat electronic documents differently from country to country; learn the practice in the destination and transit countries in advance to avoid trouble at the border.
- For legal consequences, consult your contract and an adviser.
On Order And Load
On the platform the driver uploads a photo or PDF of the signed CMR straight to the order at delivery. That does not replace an e-CMR platform, but it attaches the paper document to the order immediately. For terms see the glossary.
